Terms of Service

The short version. Draw whatever you like — drawing, tracing and saving are free. Rendering with AI costs tokens, which you buy in packs. Your drawings stay yours. Don't use Inkmagik to make anything illegal or harmful. If a render fails, it doesn't cost you a token. Your gallery only keeps your latest few pictures — download anything you want to keep, because deleted images can't be recovered.

1. About these terms

Inkmagik is operated by Laurens Derks, a sole trader based in New South Wales, Australia ("we", "us"). By using Inkmagik you agree to these terms. If you don't agree, please don't use the service.

2. Who can use Inkmagik

You must be at least 13 years old to use Inkmagik. If you are under 18, you may only use it with the permission of a parent, guardian or teacher, and that adult must make any purchases on your behalf.

Signing in uses your Google account. You're responsible for keeping that account secure and for activity that happens under it.

3. What's free and what costs tokens

Drawing, tracing a photo, and saving your picture to your device are free and don't require an account. Rendering — turning your drawing into finished artwork with AI — requires you to be signed in and costs tokens:

If a render fails, you are not charged — tokens are only deducted once artwork is successfully produced.

4. Tokens and payment

Refunds

If you change your mind, email us within 30 days of purchase and we'll refund any unused tokens. Tokens already spent on renders can't be refunded, because the artwork has already been generated and paid for.

Your rights under the Australian Consumer Law are not affected by this policy. If the service is faulty or not as described, you may be entitled to a refund, repair or replacement regardless of the above. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.

5. Your drawings and artwork

You keep ownership of the drawings you create. We don't claim any rights over your artwork.

To make Inkmagik work, you give us permission to store your drawings and to send them to our AI provider (OpenAI) to produce the rendered artwork. We use them for nothing else — we don't publish them, sell them, or use them to train AI models.

Rendered artwork is created using OpenAI's image models and is subject to OpenAI's terms as well as these. AI output can be unpredictable: we can't guarantee that any render will match your expectations, or that similar output won't be produced for someone else.

Your gallery is temporary — save what you want to keep

Inkmagik is not a storage service, and your gallery is not a backup. We keep only your most recent renders — currently the latest five. Each time you create a new render beyond that limit, your oldest image is permanently deleted automatically.

Deleted images cannot be recovered. We have no way to restore them, and neither do you — so if you want to keep a picture, use Save drawing to download it to your own device before you make another render.

You are responsible for keeping your own copies of anything you want to keep. We are not liable for the loss of artwork that has been removed by this automatic clean-up, or lost for any other reason. We may change how many images are kept, or stop offering the gallery, at any time.

6. Acceptable use

Don't use Inkmagik to create, upload or render:

Also, please don't try to break the service — no automated scraping, no attempts to bypass token charging, and no probing our systems for weaknesses.

We may suspend or close accounts that break these rules.

Content filtering

Inkmagik is built for school-age users, so automated content filters run on every render. Your instructions are screened before rendering, and our AI provider screens both the drawing and the finished image against its own safety policies. Requests involving adult, sexual, graphically violent or otherwise inappropriate content are refused.

If a render is blocked you'll be told, and you won't be charged a token.

No automated filter is perfect. We can't guarantee that every inappropriate request will be caught, or that every blocked one deserved to be. Attempting to produce prohibited content is a breach of these terms regardless of whether the filter stops it, and we may suspend or close the account of anyone who tries.

If you're a parent or teacher and something inappropriate does get through, please tell us at hello@inkmagik.app so we can look into it.

7. Availability

Inkmagik is a small, independently run service. We aim to keep it running but can't promise uninterrupted availability — it may be unavailable for maintenance, or because a provider we depend on (such as OpenAI) has an outage. We may change or discontinue features over time.

If we permanently shut the service down, we'll give reasonable notice and refund unused tokens.

8. Closing your account

You can ask us to delete your account at any time by emailing hello@inkmagik.app. We may suspend or close an account that breaches these terms. If we close your account without cause, we'll refund any unused tokens.

9. Liability

To the extent permitted by law, Inkmagik is provided "as is", and we are not liable for indirect or consequential loss arising from your use of it. Where we are liable and the law permits us to limit that liability, our total liability is limited to the amount you paid us in the previous 12 months.

Nothing in these terms excludes or limits any right you have under the Australian Consumer Law that cannot legally be excluded.

10. Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they last changed, and significant changes will be highlighted in the app. Continuing to use Inkmagik after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction over any dispute.
